Your Privacy:

In order for us to provide our services to you, we need to collect your personal information. By providing your personal information you agree to using it to provide our service to you, and also disclosing it to our third-party service providers, in particular our bank/direct debit company, in order to store your sensitive information securely. If you do not agree you must not provide your personal information, however we will be unable to provide our service to you. We may also use your personal information and photographs/videos of you for our direct or indirect marketing purposes however you may opt out by advising us in writing at any time. By signing below, I agree to the use of my personal information as described only.

 

Membership Details, Terms & Conditions:

The ongoing payment is due each billing period selected & will be processed by automatic deduction commencing on the Commencement Date opted for and recur indefinitely on a frequency as selected (weekly, fortnightly or monthly) for a minimum of 12 weeks unless stated otherwise & agreed in writing by Brighton Group Fitness & PT management. This membership allows the person applying to attend the allocated amount of training classes selected for the period of this agreement (subject to availability). An industry standard cooling off period of 48 hours applies to this agreement.

 

GENERAL OBLIGATIONS - A Membership with Brighton Group Fitness & PT requires you to:

  • Update your contact details within 14 days if they change.

  • Attend all planned meetings, respond to regular communications and put in your best effort.

  • Notify Brighton Group Fitness & PT direct & as soon as possible if you are unhappy with anything and not approach any other members with your concerns, complaints or negative comments. 

  • Act appropriately & respectful toward others at all times.  

  • Pay all agreed fees, ensure sufficient funds are available to cover all fees and advise us in advance if your bank account or credit card is closed or changed.

  • Any fee’s associated with incorrect details or dis-honoured fees will not be refunded & is your responsibility.

  • Inform us in advance if there are any risks to your health if you participate in fitness services and if required seek approval from your Doctor, General Practitioner or any other practitioner in relation to your case.

  • Not attend any class, event or interact with anyone if feeling unwell, have a fever or been to an at risk place for any known diseases or sickness in the past 14 days. 

  • Notify Brighton Group Fitness & PT if you may have been exposed or someone close to you may have been exposed to any infectious or contagious disease or sickness in the past 14 days. 

  • Cancel a group training session at least 1 hour before the start time for group training sessions. Any late cancellation within 1 hour before the group session or no show to the group session, will forfeit the session. 

  • Give at least 6 hours notice if needing to cancel a session for private or semi-private personal training clients only. If you are unable to attend a scheduled private/semi-private session or appointment, you agree to forfeit the session by paying a late cancellation fee (“Cancellation Fee”) of up to 100% of the Training Fee for less than 2 hours’ notice and no-shows, in accordance with Trainer Cancellation Policy as updated from time to time.

  • To avoid payment of Cancellation Fees, you understand you must provide more than 6 hours’ notice, otherwise cancellation less than 6 hours prior to the Session but more than 2 hours’ notice will incur a Cancellation Fee equivalent to only 50% of the Session Fee. 

  • Cancellation made in excess of 6 hours’ (private/semi-private) or 1 hours' (group training) notice will not attract any Cancellation Fee, and where possible an alternative time will be offered to you.

OVERDUE FEES

If your automatic direct debit fails, reverses or is returned to us by your financial institution the following process will apply:

  • Brighton Group Fitness & PT or the third party direct debit merchant used will attempt to contact you about re-trying the debit.

  • If the scheduled debit is not paid on the due date, the outstanding (+ fees) will be processed 3 days after the due date. If the fee is still not paid after re-trying once, the debit will be attempted again 3 days later and another late fee will be added on as stated in this agreement.

  • If you fail to pay us the balance +fees by the due date, we are entitled to refuse service, unless other arrangements have been made in writing by Brighton Group Fitness & PT.

  • If unpaid fees remain outstanding and after attempts by us to rectify the arrears, your amounts owed may be forwarded to a collection agency for further action.

  • Brighton Group Fitness & PT reserves the right to vary the process set out in this clause by providing you with one month advance written notice of any changes.

Cancellations after minimum term:

  • Brighton Group Fitness & PT requires you to contact us in writing to the email address provided in the membership agreement advising of your cancellation request.

  • There will be a period of 14 days notice required from the date of cancellation request to the date of termination, during which any payments that fall due must be paid in full, unless otherwise specified in writing.

  • The notice period will exclude suspension or payment break time applied to your membership.

  • Any installments/fees due at the date of termination (including installments/fees which fall due during the notice period) will remain a debt owed to and recoverable by Brighton Group Fitness & PT and/or the direct debit merchant engaged.

  • You shall not consider that your membership agreement has been terminated until such time as this is confirmed in writing to you by Brighton Group Fitness & PT (not more than 14 days after the termination date).

  • Termination of your membership agreement will also terminate the Direct Debit Request Authority.

Cancellations Due to Permanent Sickness, Physical Incapacity or Moving Away:

Brighton Group Fitness & PT requires a medical certificate stating that you cannot utilise any fitness services because of your permanent illness or physical incapacity. Proof of new address must be supplied and to be more than 10km from the nearest training location (unless approved in writing by Brighton Group Fitness & PT management). An admin fee of $5 (+ Direct debit fees) will be charged for processing this unless approved in writing from Brighton Group Fitness & PT management. 

Cancellation for any other reason (within minimum term):

You may terminate your membership agreement before the expiry of the minimum term (or payment amount) if all instalments and fees due up to the date of termination are paid and the relevant cancellation fee is paid in full at the time of cancellation request (see below).

This membership is a non-refundable package for a 12-week minimum. An early cancellation fee of 25% of what is owed of the minimum total amount will apply if cancelled before 12-weeks has ended from the sign up date.

MEMBERSHIP SUSPENSION:

Suspension of payments may be possible under the terms of your Membership Agreement as stated here:

  • Payments may be suspended for a minimum of 1 weeks at a time so long as the total time suspended within 12 months does not exceed 6 weeks (unless approved in writing by Brighton Group Fitness & PT management). 

  • In order to suspend payments you should contact Brighton Group Fitness & PT at least 3 days prior to the date of the first suspended payment via the suspension form supplied. Just by submitting the form does not mean the suspension is instantly approved and processed, this is only approved when confirmation has been sent by Brighton Group Fitness & PT management. 

  • Any time spent on suspension during the minimum term will be added onto the minimum term of the Membership Agreement so that the minimum sum of the instalments payable for the minimum term or number of payments shall still be payable regardless of any suspension or suspension charges made within the minimum period.

 

We do not offer any guarantees that you will have unachievable results. These classes, the nutrition & exercise programs are general guidance, these are all done at your own risk, Brighton Group Fitness & PT, it’s contractors, volunteers or affiliations will not and can not be held liable for any injury, damage, death or any other issue that may arise during this membership or any event participation. By signing the agreement and indicating for the payment method selected, you are agreeing to these fees & terms.

*Please note our third-party direct debit merchant has small fees that will be added on to your base membership payments payments. All membership fees, direct debit fees and/or other fees are non-refundable unless approved in writing by Brighton Group Fitness & PT. For our retreats, reasonable notice of at least 30 days must be given if wishing to cancel or reschedule the event from the participant, no cancellation refunds or reschedules will be available in the 30 days prior to the scheduled date unless approved in writing by Brighton Group Fitness & PT. All fees are outlined in this document or the payment page and must be agreed to by the applicant signing the document before proceeding or proceeding with checkout.
